Initiating
When instructed to initiate or prosecute a disciplinary hearing, Mhlanga Attorneys follow a specific methodology. Upon receiving instructions, we promptly schedule an appointment with the person responsible for the disciplinary process.
Presiding
Once a guilty finding is made, recommendations on the most appropriate sanction, taking into account all aggravating and mitigating factors, will be provided. The client will receive written advice regarding both the verdict and the recommended sanction.
Prosecuting
We will then proceed to prosecute and ensure the finding of guilt against the employee. Additionally, we will present arguments to the presiding officer in favour of imposing the appropriate penalty.
Litigation
Our approach in all matters referred to us is to first assess the client's prospects of success in each matter and advise them accordingly. When the client's prospects are not favourable, we will recommend considering settlement and pursuing the best available settlement deal based on the facts of each case.
